7.1 Platform Intermediary Role and Scope of Service

  • Nature of Intermediary Service: As an intermediary agency for trademark assignment transactions, this Platform mainly provides auxiliary services such as procedure handling, material submission, and information display, and charges corresponding trademark agency service fees. The Platform does not directly participate in or dominate the transaction decisions of both buyers and sellers, nor does it intervene in trademark price negotiation or transfer of ownership.
  • Information Source Statement: The trademark assignment information displayed on this Platform is published by users themselves or synchronized through authorized third-party interfaces. Given the vast number and diverse sources of trademark information, the Platform does not have the capability nor the obligation to review the authenticity, legality, completeness, or timeliness of all information one by one. Users should verify the authenticity and validity of the information themselves, make independent judgments, and bear transaction risks and legal liabilities.
  • Platform Liability Statement: In the process of providing trademark agency services, if the Platform fails to fulfill the entrusted purpose due to its own reasons, the Platform will bear corresponding refund liabilities in accordance with the "Refund Policy" or the service agreement signed by both parties. The Platform does not assume legal liability for trademark ownership, transaction results, performance risks of buyers and sellers, or disputes arising from third-party reasons.
  • Legal Compliance Statement: This Platform firmly opposes any illegal and irregular behaviors. No institution or individual may obtain services through the Platform and use them for illegal, infringing, fraudulent, or other improper purposes. 7.2 Prevention of Malicious Trademark Agency and Transaction Risks

  • Strict Prohibition of Malicious Agency: According to the Trademark Law of the PRC and relevant regulations, this Platform strictly prohibits malicious trademark registration applications and agency behaviors not for the purpose of use. If the Platform discovers that users are engaging in such activities through this Platform, it has the right to immediately terminate the service without refunding any fees.
  • Buyer's Due Diligence Obligation: Before purchasing a trademark, the buyer should actively conduct due diligence to understand the ownership status, usage history, and potential legal issues of the trademark (such as whether there are objections, invalidation declarations, renewal risks, etc.). It is recommended to consult professional institutions or lawyers to identify and prevent risks.
  • Risk of Changes in Trademark Status: The legal status and applicable rules of trademarks may change over time and with policy adjustments (such as adjustments to the examination standards of the China National Intellectual Property Administration, risk of becoming generic terms in the industry, etc.). Users should fully understand and assess the risks when purchasing.
  • Displayed Pattern Statement: To optimize page display effects, the displayed trademark patterns may be system-rendered or style-adjusted based on the original patterns for display reference only, and do not represent the patterns filed with the China National Intellectual Property Administration. Users should verify the consistency of the pattern and registration information themselves.

7.3 Refund of Agency Fees and Fee Restrictions

  • Agency Fee Refund Mechanism: If the trademark assignment application is unsuccessful due to uncontrollable factors such as policy changes or adjustment of examination standards by the China National Intellectual Property Administration, the Platform will refund the agency service fee in accordance with the "Refund Policy" after excluding the user's own reasons.
  • Explanation of Collection and Payment on Behalf: For trademark fees, notarization fees, etc., collected and paid by the Platform on behalf of others, the Platform only acts as a collection and payment channel and does not assume the obligation of return or recovery. Users can verify with relevant institutions themselves based on payment vouchers.
